ONLINE STORE TERMS AND CONDITIONS
The owner of the online store Ottomar (hereinafter referred to as the Online Store) is OÜ Vasula Farmid (registration code 14318823), located at Sigala Vasula village, 60535 Tartu Parish, Tartu County, Estonia.
Validity of the Sales Agreement, Product, and Price Information
These terms and conditions apply to purchases made from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. All prices of products sold in the Online Store are in euros.
The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the products is provided directly next to the product in the Online Store.
Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required information fields must be filled in, and a suitable delivery method must be selected. The total payment amount will then be displayed, which can be securely paid using the following payment methods:
- Estonian bank payments
- Visa/Mastercard payments
NB! When paying via bank link, be sure to click the "Return to Merchant" button on the bank’s page.
Payments are processed by Maksekeskus AS. Payment takes place in a secure environment outside the Online Store—when paying via bank link, in the respective bank’s secure environment, and when paying by credit card, in Maksekeskus AS's secure environment. The seller does not have access to the buyer’s bank or credit card details. The agreement takes effect upon the receipt of the payment in the Online Store’s bank account.
The Online Store owner is the controller of personal data and transfers the necessary personal data required for payment processing to the authorized processor, Maksekeskus AS.
If the ordered goods cannot be delivered due to stock depletion or for another reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded immediately, but no later than within 14 days of sending the notice.
Delivery
Goods are shipped to the following country: Estonia.
The buyer has the following options for receiving the goods:
- Parcel machines via Omniva or DPD.
- Self-pickup at the following address: Sigala Vasula village, 60535 Tartu Parish, Tartu County, Estonia.
The shipping costs are covered by the buyer, and the relevant price information is displayed next to the chosen delivery method.
Domestic shipments within Estonia generally arrive at the specified destination within 3-5 business days from the entry into force of the sales agreement.
In exceptional cases, the right to deliver the goods within up to 45 calendar days is reserved.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the sales agreement concluded in the Online Store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day return right, the ordered goods must not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods, as would be allowed in a physical store.
If the product has been used for purposes other than necessary to determine its nature, characteristics, and functionality, or if it shows signs of use or wear, the Online Store has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.
To return the goods, a withdrawal application must be submitted, which can be found here:
The application must be sent to kaisa@vasula.ee within 14 days of receiving the goods.
The buyer bears the return shipping costs unless the reason for the return is that the product does not match the order (e.g., incorrect or defective item).
The buyer must return the goods within 14 days of submitting the withdrawal application or provide proof that they have handed over the goods to the courier within that period.
The Online Store will refund the buyer immediately, but no later than within 14 days from the date of receiving the withdrawal application, all fees received under the agreement.
The Online Store may refuse to issue a refund until the returned goods have been received or until the buyer has provided proof that the goods have been sent back, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the most affordable standard delivery option offered by the Online Store, the Online Store is not required to reimburse the additional costs exceeding the standard delivery cost.
The Online Store has the right to withdraw from the sales agreement and reclaim the goods if the price of the goods in the Online Store has been mistakenly marked significantly below the market price.
Right to Submit Complaints
The Online Store is responsible for any non-conformity of the sold goods with the contract or defects that existed at the time of delivery and which appear within two years of the transfer of the goods to the buyer. Within the first year after delivery, it is presumed that the defect was present at the time of delivery. It is the Online Store’s responsibility to refute this presumption.
If a defect occurs, the buyer must notify the Online Store within two months by sending an email to kaisa@vasula.ee or calling +372 58378121.
The Online Store is not responsible for defects that occur after the goods have been handed over to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the defective goods will be repaired or replaced. If it is not possible to repair or replace the goods, the Online Store will refund the buyer all costs incurred under the sales agreement.
The Online Store responds to consumer complaints in writing or in a format that allows for written reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store only uses the buyer’s personal data for processing orders and delivering goods. The Online Store forwards personal data to logistics companies for the purpose of delivering goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has explicitly given consent by entering their email address on the website and opting in to receive direct marketing communications.
The buyer can unsubscribe from promotional emails and newsletters at any time by notifying the Online Store via email or by following the instructions provided in the promotional emails.
Dispute Resolution
If the buyer has complaints regarding the Online Store, they should be sent to kaisa@vasula.ee or by calling +372 58378121.
If the buyer and the Online Store cannot resolve the dispute through negotiations, the buyer can turn to the Consumer Disputes Committee. The conditions for proceedings and the option to submit an application can be found here. The Consumer Disputes Committee is authorized to resolve disputes arising from contracts between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
The buyer can also submit a complaint via the European Union’s online dispute resolution platform.
